Desperate: Chocolate/Black Tort?

I only have one picture of it, But I'm trying to weave together the puzzle pieces of what my rabbit's genotypes were. I bred rabbits for a while but never kept track of genetics - I just enjoyed the cool colors they had.

I don't have the rabbits anymore...but I attached a pic and was wondering if it's a Chocolate Tort or Black tort?

Dad: Black (aaBbCCDDEe)
Mom: Sable Point (aaB_cchlcchlDDee)

Please read this also:
They had a lot of blacks and black torts, but once I think they MAY have had a chocolate baby. However, it died at roughly 5 days old and I'll never know :(
The Black father also produced chocolate chestnuts with another Chocolate Chestnut female, so he carries 'b'.

Case for Black: Out of roughly 20 other babies bred from that pair, all were Black/Black Tort (unless I missed some dark choc. torts)
Case for Chocolate: Father holds chocolate, has much less shading than the Black Torts I've seen
